Terms of Use
Welcome to The Aloha Post (also "Send Your Aloha"), a service of Sea Light Print Shop ("we," "us," or "our"), based in Hawaiʻi. These Terms of Use ("Terms") are the agreement between you and Sea Light Print Shop for your use of our voice-message app at app.sendyouraloha.com (the "App").
Please read these Terms. By using the App — whether you are recording a message or listening to one — you agree to them. If you do not agree, please do not use the App.
What the App is
The App lets a sender record a short voice message and attach it to a physical greeting card through a scannable seal. The recipient scans that seal to hear the message, and may choose to save it.
The App itself is a feature for using your voice with a card. No purchase or payment happens in the App. Any membership or product purchase is handled separately through our store on Shopify, under that store's own terms.
Who may use the App
You must be at least 18 years old (or the age of majority where you live) to record and send a message. By recording or sending, you confirm that you are old enough to agree to these Terms.
Your responsibilities
You are responsible for the messages you record and send. By using the App, you agree that:
- You have the right and consent to record and send the voice in your message. This includes getting consent from any other person whose voice you record, and getting a parent's or legal guardian's consent before you include a child's voice.
- You will not use the App to record or send anything that is unlawful, harassing, threatening, abusive, defamatory, obscene, hateful, invasive of privacy, or infringing on anyone's rights.
- You will not use the App to impersonate anyone, to deceive, or for any unlawful or harmful purpose.
- You will not attempt to disrupt, damage, reverse-engineer, or gain unauthorized access to the App or its systems.
You are solely responsible for the content of your recordings, and for making sure you have the right to record and share them.
Your content and the permission you give us
The voice message you create is yours. To provide the service, you give us a limited permission to store, process, host, and deliver your recording for the purpose of operating the App — that is, so the recipient can scan the seal and hear it, and save it if they choose. You can ask us to delete a recording (see our Privacy Policy). We do not claim ownership of your recording and do not use it for advertising.
If you are a recipient
If you receive a message, you may listen to it and, where offered, save a personal copy for your own keepsake. Please respect the personal nature of these messages and the privacy of the people in them.
Things we cannot promise
We provide the App "as is" and "as available." We work hard to make it lovely and reliable, but we do not promise that it will always be available, uninterrupted, error-free, or that recordings will be permanently preserved or always successfully delivered. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We are not responsible for lost, deleted, undelivered, or inaccessible recordings, or for events outside our reasonable control.
Limitation of liability
To the fullest extent permitted by law, Sea Light Print Shop and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data (including lost recordings), arising out of or relating to your use of the App.
To the fullest extent permitted by law, our total liability for any claim relating to the App will not exceed one hundred U.S. dollars ($100), or the amount you paid us, if any, for the use of the App that gave rise to the claim, whichever is greater.
Some places do not allow certain limitations, so some of the above may not apply to you.
Your promise to cover certain claims (indemnification)
You agree to defend, indemnify, and hold harmless Sea Light Print Shop and its owners, employees, and contractors from any claims, damages, losses, or costs (including reasonable attorneys' fees) arising out of your misuse of the App, your recordings, or your violation of these Terms or of anyone's rights — including your recording or sending of a voice without the necessary consent.
Our rights
We may, at our discretion and where appropriate, remove content, limit, suspend, or end access to the App for anyone who violates these Terms or uses the App in a way that is harmful, unlawful, or abusive.
Other services
Purchases, memberships, and payments happen through our Shopify store and are governed by that store's separate terms and policies. We are not responsible for third-party services or websites the App may link to.
Governing law and where disputes are handled
These Terms are governed by the laws of the State of Hawaiʻi, without regard to its conflict-of-laws rules. You agree that any dispute relating to the App or these Terms will be brought exclusively in the state or federal courts located in Hawaiʻi, and you consent to the jurisdiction of those courts.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. By continuing to use the App after changes take effect, you agree to the updated Terms.
